1. Purpose and Scope
This notice describes how Podcast Laundry, LLC, operating as GOE, collects, uses, shares, and protects Consumer Health Data. It is provided under the Washington My Health My Data Act (RCW 19.373), the Nevada consumer health data law (SB 370), and comparable laws elsewhere. It applies to all GOE members.
GOE is a peer accountability community. GOE is not a healthcare provider, does not deliver medical care, and does not diagnose or treat any condition.
2. Categories of Consumer Health Data We Collect
"Consumer Health Data" means personal information linked or reasonably linkable to you that identifies your past, present, or future physical or mental health status. We collect:
- Goals you write in the Health and Well-Being category and in any other category, including free text that may describe fitness activity, exercise, weight, body measurements, nutrition, sleep, mental health status, or an intention to seek or obtain health care services.
- Progress entries, notes, and comments relating to those goals.
- Completion percentages, tier placement, streaks, and leaderboard standing to the extent they reflect health related goals.
- Inferences we derive from the above about your health status or your efforts to improve your health.
We do not collect biometric data, genetic data, diagnostic or clinical records, or data from connected medical or fitness devices. GOE asks members to record target goals rather than medical detail.
3. Sources
We collect Consumer Health Data directly from you, through the goals, entries, notes, and comments you choose to enter into the GOE platform. We do not purchase Consumer Health Data and we do not obtain it from data brokers, health care providers, insurers, or other third parties.
4. Why We Collect and Use It
- To operate the GOE accountability program, including recording your goals and entries.
- To calculate your completion percentage and merit tier.
- To place you on an accountability team and display your progress to your team.
- To display your completion percentage, tier, and standing on the GOE community leaderboard, which is visible to other GOE members.
- To send you optional reminders about entries you have not submitted.
- To provide support, moderate the community, and enforce our terms.
- To produce aggregate, de-identified community statistics.
- Where you have given separate marketing permission, to use your health related performance information and progress narratives in GOE marketing, sales, grant, investor, and press materials, without identifying you by name.
We do not use Consumer Health Data for targeted or cross context behavioral advertising, and we do not use it to make decisions about your eligibility for credit, insurance, employment, or housing.
5. Who Receives It
**Affiliates. **Podcast Laundry, LLC has no affiliates that receive Consumer Health Data as of the Effective Date. If a separately formed GOE entity or other affiliate later receives Consumer Health Data, this notice will be updated to name that specific affiliate before any such sharing occurs.
**Service providers. **We share Consumer Health Data with a small number of established providers in the following categories, solely to operate the platform and only on our instructions: database and authentication hosting, application hosting, and email delivery. Each is bound by a contract requiring it to process Consumer Health Data only in accordance with our instructions and consistent with this notice, and to assist us in fulfilling your rights requests.
**A current list naming each specific provider that receives Consumer Health Data, with contact details for each, is available on request **to support@goe365.com, and is included automatically in any access request response. We do not publish that list on this page.
We do not send Consumer Health Data to our payment processor.
**Other members. **Your health related goals and progress are visible to the members of your accountability team, and your completion percentage and tier are visible to all GOE members on the leaderboard. You consent to this at signup.
**Legal and safety. **We may disclose Consumer Health Data to comply with a subpoena, court order, or other legal obligation, or to prevent or respond to a threat of harm to you or another person.
6. We Do Not Sell Consumer Health Data
We do not sell Consumer Health Data and have never sold Consumer Health Data. We will not sell Consumer Health Data. If that ever changes, we will obtain your valid written authorization in advance, in the form and with the disclosures required by applicable law, before any sale occurs.
7. Consent
We collect and share Consumer Health Data only with your affirmative, opt in consent, given through a checkbox at signup that is separate from and not bundled with acceptance of any other document. We do not infer consent from your use of the platform, from your acceptance of our Terms and Conditions, or from your failure to act.
If we later wish to collect a new category of Consumer Health Data or use it for a new purpose not described here, we will update this notice and obtain your new consent before doing so.
8. Your Rights
- Confirm and access. Confirm whether we are collecting, sharing, or selling your Consumer Health Data, and access it, including a list of all third parties and affiliates that received it and an active contact for each.
- Withdraw consent. Withdraw your consent to our collection and sharing at any time.
- Delete. Request deletion of your Consumer Health Data. On a verified request we delete it from our records, including archived and backup systems, and instruct all providers and third parties that received it to delete it as well.
- Appeal. Appeal any denial of a request.
Withdrawing consent to collection means we can no longer operate your GOE membership, because goal and progress data is the core of the service. If you withdraw, we will close your account and delete your Consumer Health Data.
**No waiver. **Nothing in the GOE Terms and Conditions or any other GOE agreement waives, limits, or restricts these rights. Any term that would conflict does not apply to the extent of the conflict.
**No retaliation. **We will not deny you service, charge you a different price, or provide you a different level of service because you exercised any right described here, other than the necessary account closure that follows a withdrawal of collection consent.
9. How to Exercise Your Rights
Email support@goe365.com with the subject line "Consumer Health Data Request" and state which right you are exercising. You do not need a GOE account to make a request, and you do not need to give a reason. We may ask for information reasonably necessary to verify your identity.
**We respond within 30 days of receipt. **Where a request is unusually complex we may need longer, and we will tell you the reason.
Before acting on a request we will take reasonable steps to confirm that you are the person the information relates to, or someone authorised to act for them. We may decline a request we are unable to verify. If we hold no Consumer Health Data about you, we will say so.
10. Appeals
If we decline to act on your request, we will tell you why and how to appeal. To appeal, reply to our response or email support@goe365.com with the subject line "Consumer Health Data Appeal." We will respond in writing within 30 days with our decision and the reasons for it.
**If we deny your appeal you may complain to a regulator. **Members in Washington may contact the Washington State Attorney General, members in Nevada may contact the Nevada Attorney General, members elsewhere in the United States may contact their state attorney general, and members in the European Union or United Kingdom may contact their national data protection authority. We will provide the relevant contact details with any denial.
11. Data Security and Access Restrictions
We restrict access to Consumer Health Data to those employees, contractors, and providers for whom access is necessary to provide the service or to comply with law. We apply administrative, technical, and physical safeguards, including encryption in transit and at rest, authentication controls, and row level access restrictions on member records.
12. Location Data and Geofencing
**We collect your time zone, and general location information derived from it or from your device, **because GOE runs cycles, deadlines, scoring, and reminders in each member's local time and cannot function correctly without knowing it. We do not collect precise GPS location and we do not track your movements.
We do not use geofencing. We do not implement any virtual boundary around any health care facility, and we do not use location to identify, track, or infer anything about your health.
13. Retention
We retain Consumer Health Data for as long as your account is active and only as long as reasonably necessary for the purposes described in Section 4, unless a longer retention period is required by law. We delete or irreversibly de-identify it on a verified deletion request or when it is no longer needed. Irreversibly de-identified aggregate statistics are no longer Consumer Health Data and may be retained indefinitely.
14. Changes to This Notice
We will post any updated version at the same location with a new Effective Date and Version number. We will not collect, use, or share Consumer Health Data in a manner materially different from what is described here without first updating this notice and obtaining your affirmative consent.
