**You sign this once. **After you accept it, every testimonial you choose to send GOE, now or years from now, is automatically covered. You will never be asked to sign again. This Release is optional and is not required to participate in GOE.
1. What This Release Covers
This Release applies to any and all testimonial videos, audio recordings, written statements, and still images that you voluntarily submit to GOE, whether submitted before accepting this Release or at any time in the future, together with any clips, excerpts, captions, transcripts, subtitles, and derivative versions GOE creates from them.
**It also covers photographs, video, and audio in which you appear that are captured at a GOE event, seminar, workshop, retreat, meet up, or recorded online session, **where GOE has given notice that recording is taking place and you choose to attend or remain. Notice will be given before recording begins and you may ask not to be included.
All of the above are together called "Submitted Testimonials."
Each submission reaffirms this Release. Every time you send GOE a testimonial, you confirm that this Release is in effect and that the submission becomes a Submitted Testimonial subject to it, automatically, with no further signature, form, or approval required from you.
2. Grant of Rights
You grant Podcast Laundry, LLC, its affiliates including any GOE entity formed in the future, and their successors and assigns, a perpetual, worldwide, royalty free, fully paid, transferable, and sublicensable license to use, reproduce, edit, adapt, caption, subtitle, excerpt, combine with other material, distribute, publicly display, publicly perform, and transmit the Submitted Testimonials, in whole or in part, in any and all media now known or later developed, including websites, social media, email, paid advertising, presentations, sales pages, grant applications, investor materials, and press.
**Identification. **This license includes the right to identify you by your first name or by your GOE username, whichever GOE chooses, together with your membership tenure, in connection with a Submitted Testimonial. GOE will not attach your surname or full name unless Section 2 below applies.
**If you identify yourself, that is your consent. **Members often say their own name on camera, show their face, or mention where they live or work. Where you voluntarily identify yourself in a Submitted Testimonial, that submission is itself your consent for GOE to publish those details as they appear in it, including your full name and your image. Nothing further needs to be signed and no separate written consent is required.
This consent is limited to the Submitted Testimonial in which you identified yourself, and to clips and derivatives of it. Identifying yourself in one testimonial does not permit GOE to use your full name or image in unrelated marketing material, and does not change what GOE may publish about any other member.
**Performance statistics. **GOE may pair a Submitted Testimonial with your tier, completion percentages, or goal outcomes if you have given marketing permission. Because those figures can reflect health or fitness goals, that permission is captured separately and can be withdrawn separately, and this Release does not replace it.
**Irrevocable as to what you have already sent. **As to any Submitted Testimonial you have already submitted, and any that GOE has already published, this license is irrevocable, because GOE and third parties rely on published materials that cannot be recalled.
3. What This Release Does Not Cover
This Release is deliberately narrow. It does not:
- Grant any general right to your name, image, likeness, voice, or persona. GOE may use them only as they appear within a Submitted Testimonial.
- Cover any footage, recording, photograph, or image that you did not voluntarily submit and that was not captured at a GOE event or session with notice under Section 1.
- Cover anything recorded without your knowledge, including team calls, general body calls, coaching sessions, platform screens, or anything captured by an artificial intelligence note taker, meeting assistant, or transcription tool.
- Authorize any artificial intelligence or machine learning training, synthetic media, voice cloning, deepfake, or digital replica use of your voice or likeness. Any such use requires your separate, specific, written consent.
- Authorize use of a Submitted Testimonial in a way that materially misrepresents what you said or falsely attributes statements to you.
- Authorize sublicensing of a Submitted Testimonial to an unrelated third party for that party's own advertising.
**Advertising platforms are covered. **Placing a Submitted Testimonial as an advertisement on Facebook, Instagram, YouTube, LinkedIn, TikTok, or any similar platform is GOE advertising GOE, and is permitted. Those platforms are distribution channels carrying GOE's advertising, not third parties advertising their own products using your image. Agencies and contractors acting on GOE's behalf are likewise covered.
4. Your Confirmations
By accepting this Release and by submitting any testimonial you confirm that:
- You are 18 or older and have the full right to grant this Release.
- Your testimonial is not paid for by GOE unless GOE and you have separately agreed otherwise in writing.
- Each testimonial reflects your honest, current opinion and your actual experience with GOE.
- You own or have permission for everything in the submission, including music, images, and any other person who appears or speaks in it.
- Your submission does not name or initial any other GOE member in connection with anything they shared, in accordance with Part III of the GOE Terms and Conditions.
- You understand your results may not be typical and that GOE does not guarantee results.
5. GOE Decides Whether to Use It
**GOE is under no obligation to use, publish, or continue using any Submitted Testimonial, **and may decline to use one, remove one, or edit one at any time and for any reason, including at your request or against it. Submitting a testimonial does not entitle you to have it published, to have it remain published, or to any placement, prominence, or duration of use.
You submit testimonials voluntarily and receive no payment unless separately agreed in writing. You waive any right to inspect or approve the finished materials in which a Submitted Testimonial appears, provided GOE does not materially misrepresent what you said.
6. Stopping Future Use
You may ask GOE to stop using a Submitted Testimonial in future materials by emailing support@goe365.com. GOE will use commercially reasonable efforts to discontinue future use within a reasonable time, generally 30 days for materials under GOE's direct control.
This does not require GOE to recall, destroy, edit, or remove materials already printed, published, broadcast, distributed, embedded, cached, syndicated, or held by third parties, and does not affect the irrevocable license in Section 2.
Leaving GOE, cancelling your subscription, or having your account closed does not by itself withdraw this Release or terminate the license granted here.
7. Release of Claims
You release Podcast Laundry, LLC, its affiliates including any GOE entity formed in the future, and their respective past, present, and future officers, directors, members, managers, employees, contractors, agents, successors, and assigns from any and all claims arising out of the use of Submitted Testimonials as permitted by this Release, including claims for invasion of privacy, right of publicity, defamation, false light, or infringement, except claims arising from use that materially misrepresents what you said or that exceeds the scope of this Release.
8. Your Privacy Rights Are Not Waived
Nothing in this Release waives, limits, or restricts any right, remedy, or protection you have under any applicable privacy or consumer health data law, including the General Data Protection Regulation, the UK GDPR, the Washington My Health My Data Act, the Nevada consumer health data law, and any comparable law in your country or state. To the extent any provision would conflict, that provision does not apply to the extent of the conflict, and the rest stays in full force.
9. Assignment and Successors
Podcast Laundry, LLC may assign or transfer this Release and all rights and licenses granted under it, without your consent and without notice, to any affiliate, to a GOE entity formed in the future, or to any successor or acquirer of the GOE business or its assets. All rights granted here run to and are enforceable by those affiliates, successors, and assigns, with no further signature or action required from you.
10. Electronic Signature
You agree to sign this Release electronically. Checking the acceptance box constitutes your signature and satisfies any requirement under any law that consent to the use of your name, portrait, picture, likeness, or voice be given in writing and signed, including New York Civil Rights Law sections 50 and 51 and California Civil Code section 3344, and it is valid and enforceable under the United States E-SIGN Act, the Uniform Electronic Transactions Act, the EU eIDAS Regulation, and comparable laws elsewhere. GOE will retain a record of your acceptance including the version accepted, the date and time, and your IP address, and will provide you a copy on request.
11. Governing Law and General Terms
This Release is governed by the laws of the State of Wyoming, United States, without regard to conflict of laws principles, and is subject to the dispute resolution provisions of the GOE Terms and Conditions, except that nothing here limits any right you have under the privacy or consumer laws of your own country or state. If any provision is held unenforceable, the remainder stays in effect. This Release supplements the GOE Terms and Conditions, Privacy Policy, and Consumer Health Data Notice.
12. Acknowledgement
By checking the box below you confirm that you have read and understood this Release, that you are granting it freely, and that it will apply automatically to every testimonial you send GOE in the future without any further signature.
